The ABC has very strict reporting requirements for any changes in the information regarding holders of a liquor license (view ABC Act required reporting) ,
however, as of this date James Beach lists as its officers Bartok, LLC and Scharff Werner, LP. Bartok, LLC was cancelled as of 12/03 ( view cancelled form filed with sec. of state) , and Werner Scharff died 8/17/2006 (view news article) . but the liquor license information has never been updated, as required.

The current Canal Club liquor license information lists Werner Scharff as a director/general manager , but Werner Scharff died 8/17/2006 (view news article) ,but the liquor license information has never been updated, as required.

The Sec. of State has very strict reporting requirements for any changes in the information regarding Corporations and LLC's (view regulations for required reporting), but the Canal Club filed Articles of Incorporation in 2001, but never filed an update until 2009, at which time they filed a statement saying there were no changes, even though a director (Werner Scharff ) had died ( view Canal Club filings). Also, the articles of incorporation (filed 7/2001) show that Samakow is an officer (CEO and CFO), as well as Evans(Secretary), and that Samakow, Evans and Wearner Scharff are all Directors. However, the liquor license (as of 7/2002) shows that Samakow is the president, Evans is the vice president, and Simone Scharff and Werner Scharff are each listed as Director/General Manager.

Also, Bartok, inc., general partner of Dannys, has never filed any updates untill 2009, 5 years after incorporating, when updates are required every one or two years. Additionally, it is very possible that the business entity partner of James beach, if a corporation or LLC has never filed any updates as required (to be determined)

 James Beach has never updated its information with the sec. of state, but I am not sure if this is a requirement for a LP.

 Bartok, LLC was initiated in 9/96, as a general partner of James Beach.The filling indicates that the LLC will be managed by a manager, not a LLC member. A filing on 11/96 shows that Daniel Samakow is the manager for the LLC, On 6/98 a filing shows no change in information, and is signed by Daniel Samakow as the manager for the LLC. A filing on 6/2001 shows a change--Samakow is now listed as the CEO and President, but not a member of the LLC, and James Evans is listed as a member of the LLC. The next filing, 12/2003, a cancellation of the LLC, is signed by, Samakow, and indicates that he is a member of the LLC , even though the previous update shows him as NOT a member, but as the President and CEO ( view forms filed with sec. of state) .

A DBA was filed for James Beach on 10/96 with Los angeles county, but was never renewed, as is required every 5 years to keep the DBA valid(view James Beach DBA).
